Influx Health ("Influx Health," "we," "us," or "our") is a patient-acquisition agency and software platform for healthcare organisations, owned and operated by HXO HUB Pvt. Ltd., incorporated in India.
These Terms of Service govern your use of our website, our client platform, and the marketing and patient-acquisition services we provide. By creating an account, signing an execution blueprint, or otherwise using our services, you agree to these terms on behalf of yourself and the organisation you represent, and you confirm that you have authority to bind that organisation.
If you do not agree with these terms, do not use our services. These terms should be read together with our Privacy Policy and our Cancellation & Refund Policy.
Influx Health provides marketing and patient-acquisition services for healthcare organisations. Depending on your engagement, this includes strategy development, content production and scheduling across agreed channels, editorial calendars, a human-in-the-loop approval workflow, signal monitoring, conversion routing, and performance reporting.
The specific scope of your engagement — channels, formats, deliverables and exclusions — is recorded in the execution blueprint you sign with us. Anything listed as out of scope in your blueprint is not part of the engagement unless separately agreed in writing.
We are a marketing services provider. We are not a healthcare provider, we do not provide medical advice, and our services do not include clinical advisory, medical opinion, or regulatory submissions.
Access to the client platform is by invitation. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly if you believe your account has been compromised.
You agree to provide accurate, current information about yourself and your organisation, and to keep it up to date. You must not share credentials, misrepresent your identity or authority, attempt to access another organisation's workspace, or use the platform in a way that disrupts or degrades the service.
Your engagement begins when an authorised representative of your organisation signs the execution blueprint in the platform. The signed blueprint, together with these terms, forms the service agreement between your organisation and Influx Health. Nothing is charged before the blueprint is signed.
Content we produce moves through the approval workflow configured for your organisation. Your organisation's designated reviewers are responsible for reviewing and approving content before publication. Content approved by your reviewers is deemed authorised by your organisation for publication.
Where scheduled approvals are not actioned by your team within the agreed review windows, affected deliverables may be rescheduled. Delays caused by pending approvals, missing inputs or restricted account access do not suspend billing.
Our services are billed as a monthly subscription at the rate stated at the time you sign your blueprint. Payment of the first month is collected when the blueprint is signed, and the subscription then renews automatically each month through the payment mandate you authorise.
Payments are processed by Razorpay, our payment gateway. Card, UPI and bank details are entered directly into Razorpay's secure interface and are never seen or stored by Influx Health.
Where a promotional or coupon price applies to your engagement, the promotional terms shown at the time of signing govern its amount and duration. Promotional pricing has no cash value and cannot be applied retrospectively.
Fees are stated exclusive of applicable taxes unless indicated otherwise. GST and other applicable taxes are added at the prevailing rate.
If a renewal charge fails, the payment may be retried. If payment cannot be collected, we may pause or suspend the engagement until the account is brought current.
You may cancel your subscription at any time. Cancellation stops future renewal charges; service continues until the end of the billing period already paid for. Fees for billing periods that have already begun are non-refundable, because production work is scheduled and begins at the start of each period.
Full details, including how to cancel and how duplicate or erroneous charges are handled, are set out in our Cancellation & Refund Policy.
To deliver the engagement, we rely on you to:
You are responsible for the accuracy of clinical and factual claims in the materials you supply and in the content you approve.
Content we produce is marketing content, prepared to be consistent with applicable Indian medical advertising guidelines, including those of the National Medical Commission (NMC) and the Advertising Standards Council of India (ASCI). It is not medical advice and is not a substitute for professional clinical judgement.
Final responsibility for the compliance of published content with the rules of your profession rests with your organisation, exercised through your review and approval of each item before publication.
Upon payment of the fees for the relevant billing period, ownership of the final, approved deliverables produced for your organisation in that period is assigned to your organisation.
Influx Health retains all rights in the platform, our tools, templates, prompts, workflows, and pre-existing or reusable materials. Nothing in these terms transfers ownership of the platform or our underlying methods.
You retain ownership of the materials you supply to us, and grant us a licence to use them solely to deliver the engagement.
We may reference your organisation's name and non-confidential examples of published work in our portfolio and marketing, unless you ask us in writing not to.
Each party will keep the other's non-public business information confidential and use it only for the purposes of the engagement. This obligation does not apply to information that is publicly available, independently developed, or required to be disclosed by law. Our handling of personal information is described in our Privacy Policy.
Marketing outcomes depend on factors outside any agency's control — including your market, your service quality, platform algorithms, advertising policies and seasonality. While we work to agreed strategies and report performance transparently, we do not guarantee any specific volume of enquiries, patients, followers, rankings or revenue.
To the maximum extent permitted by law, Influx Health's total aggregate liability arising out of or in connection with the services, whether in contract, tort or otherwise, is limited to the fees paid by your organisation in the three months preceding the event giving rise to the claim.
We are not liable for indirect or consequential loss, loss of profits, loss of business, or loss of data, nor for the acts or policies of third-party platforms (such as social networks, search engines or messaging services), including account restrictions, content removals or algorithm changes.
Nothing in these terms excludes liability that cannot be excluded under applicable law.
We may suspend or terminate access to the platform or the services if fees remain unpaid after notice, if you materially breach these terms, or if we are required to do so by law. You may end the engagement at any time by cancelling your subscription as described in the Cancellation & Refund Policy.
On termination, sections that by their nature should survive — including fees owed, intellectual property, confidentiality, and limitation of liability — continue to apply.
These terms are governed by the laws of India. The parties will first attempt to resolve any dispute amicably through good-faith discussion. Failing that, disputes are subject to the exclusive jurisdiction of the competent courts at the registered office of HXO HUB Pvt. Ltd., India.
We may update these terms from time to time. Changes will be posted on this page with a revised "Last updated" date. Where a change materially affects an active engagement, we will make reasonable efforts to notify you directly. Continued use of the services after a change takes effect constitutes acceptance of the updated terms.
